Newcastle takeover insight on arbitration

A sports lawyer has dropped some enticing insight on Newcastle United’s arbitration case against the Premier League over the failed takeover.

The Lowdown: Newcastle await arbitration

A date has now been set for the pending arbitration hearing between the North East club and the top flight over the failed deal between Mike Ashley and the Kingdom of Saudi Arabia (KSA) consortium.

The case has been set for July on an expedited basis, with the division being granted an extension to respond to Mike Ashley’s separate anti-competition lawsuit.

The Latest: Sports lawyer on arbitration

As quoted by The Chronicle, Peter Nunn, who is the Head of Sports Disputes at law firm Mishcon de Reya, has dropped some enticing insight on the arbitration hearing.

He claims that ‘we may never know the full underlying reasons’ for why the panel come to their final decision, although the result will be publicly known.

Nunn also claims that the decision made by the arbitrators would be expected to be issued ‘within a month’ after the hearing, and added that ‘a decision is likely final’.

The uncertainty on both sides of the case makes it ‘fascinating’ in his eyes, as Nunn also gave some insight on what the arbitration may mean for the separate anti-competition lawsuit launched by the Tyneside club against the PL.

Nunn claimed that there is ‘no doubt’ that the Magpies would drop the anti-competition case if they prevailed in arbitration, as that one is seen as a ‘second bite of the cherry’ if they lose arbitration.

The Verdict: Arbitration key

A positive result for the Toon in the arbitration hearing is certainly key for any potential revival of the original takeover bid from the KSA group.

In a welcome relief, this would mean that the anti-competition case would effectively no longer be needed, which would save NUFC a lot of time and resources in terms of trying to get the takeover back on track.

That said, the anti-competition lawsuit may be vital if they lose the arbitration case against the league, but everything depends on the results of the latter.

With arbitration not set to start until July, it is likely that Newcastle will have to go through the whole summer transfer window without a takeover at St. James’ Park, which is not ideal given the embarrassment of riches that they would potentially have at their disposal if it were to go through.

Nonetheless, the Toon Army will no doubt be ecstatic if arbitration goes well for the Magpies and thus paves a pathway for a potential resurrection of the original deal.

Sunderland: Phillips backs O’Nien to sign a new deal

Former Sunderland player Kevin Phillips has backed star midfielder Luke O’Nien to sign a new contract with the club and fans should be delighted by this news.

What’s the talk?

Football Insider have claimed that Preston North End, Middlesbrough, Millwall and Luton Town are all tracking O’Nien’s situation closely and are prepared to pounce if he becomes available. He is out of contract at the end of the month and Sunderland have offered the midfielder a new deal to stay at the club.

Former Sunderland striker Phillips believes that “loyal” O’Nien will commit his future to the club this month and reject the chance to move to the Championship. The retired forward has claimed that O’Nien loves Sunderland and will stay if he is offered a reasonable contract. He told Football Insider:

“I think he will stay, to be honest, I think he loves Sunderland.

“He seems like a real loyal guy. As I know well, they’re very hard to find and if someone is coming in with a better offer and the chance of playing in the Championship then it’s hard to turn down, but it’s clear that he does like the club.”

“If they want to keep O’Nien they’re going to have to offer him a decent contract, but not to the point where they’re being held to ransom, so it’s getting that balancing act right.

“But I think if you offer him a good, decent contract, then he would stay.”

Fans should be delighted

Sunderland fans should be delighted by this news for multiple reasons. For starters, it is great to hear that Phillips truly believes O’Nien loves Sunderland. As the former striker has explained, loyalty can be found few and far between in the modern game and it is heartwarming to read that O’Nien could show his love for the club by signing a contract extension this summer instead of leaving on a free transfer to move to a higher division.

Fans should love to see passion on and off the pitch. Who wants to see players solely motivated by money and greed? Players like O’Nien, who thrive on the emotion and love of the game, are lovely to watch and, hopefully, he will be able to showcase his passion in front of the supporters next season if he stays at Sunderland and fans are back inside the grounds.

O’Nien’s footballing ability is another reason the fans should be happy to read this news. Charlie Wyke and Aiden McGeady, who both contributed directly to 20 goals or more, were the only players in the Sunderland squad to average a higher WhoScored rating than O’Nien in League One.

The £4k-per-week ace thrived in multiple positions on the pitch, playing at right-back, in midfield and at centre-back throughout the campaign, averaging an impressive score of 6.95. This shows his importance to the Sunderland side and why keeping him at the club could be a huge boost and a positive for the fans to enjoy.

McAvennie slams Gers’ Hagi

Frank McAvennie has slammed the behaviour of Glasgow Rangers’ Ianis Hagi and has urged Steven Gerrard to have a word with him.

The Lowdown: Hagi speaks out

Hagi has been linked with a move away from Sevilla and Lazio in recent weeks (via The Daily Record), with him recently admitting he would like to play for Galatasaray at some point in the future like his father Gheorghe did (via Emanuel Rosu).

He has also made it publicly clear he would like to go to the Olympics to represent Romania even though the Gers don’t want him to travel (via Glasgow Live).

The Latest: McAvennie slams Hagi

Speaking to Football Insider, McAvennie has slammed Hagi for speaking out. He said when asked whether Gerrard should talk to the former Genk man:

“Yes, he needs to. 

“Sometimes, the press can catch the boy off guard and he might say something he doesn’t actually mean. 

“But it seems to be every week the boy is talking about another club. Gerrard might have spoken to him already. It’s out of line.

“He’s not playing as much as his dad would like, that’s for sure. His dad is always off saying how good Ianis is. 

“If anything, his dad is doing all of this for him. I don’t think Ianis needs to instigate a move. 

“If he wants to move, I’m sure Gerrard would let him go. Especially if he’s going to keep talking out.

“You can’t have a player who is always publicly disagreeing with the club.”

The Verdict: Quiet word

It is hard to disagree with McAvennie – Hagi needs to think about what he is saying in public. Of course, the ties to Galatasaray are clear given his father’s links to the club, but he does not need to make it so abundantly clear he wants to play there – that shows a lack of disrespect to his current employers.

He may also want to play at the Olympics, but that would clash with huge Champions League qualifiers for Rangers, so the Gers have every right to stop him from travelling.

With 38 goals and 35 career assists to his name (Transfermarkt), the 22-year-old has shown he has talent, but it is still very early days. He should perhaps look to improve his game instead of courting controversy as he has done in recent weeks.

Because, in thrashing their opponents by nine wickets with more than six overs to spare in the teams’ Carlton Series match here in Brisbane tonight, the hosts showed that the West Indians are no closer now to defeating them than they have been at any stage of this wretched tour.The extent of imbalance between these teams remains so manifest that records continue to fall by the wayside too. There were a brace of new marks set tonight, a flurry of them arriving as openers Mark Waugh (112*) and Adam Gilchrist (98) slaughtered a ragged attack and set about making a mockery of the total of 8/234 that had been established by their opponents earlier in the day. Waugh and Gilchrist compiled a partnership of 206 for the first wicket to shatter previous bests for opening partnerships for Australia against West Indies; for Australia at the ‘Gabba; for Australia in all home one-day internationals; and for any team on Australian soil.It was all demoralising enough for the West Indians but what made it even worse was that stand-in Australian captain Gilchrist should have been caught by Wavell Hinds when he had a mere two runs alongside his name.Hinds had been one of the stars of the first session of the day, top scoring with a doughty fifty-four as wickets fell around him. But he could barely have started the evening session in any more humiliating style. From just the sixth ball of the Australian innings, he was presented with one of the easiest catches imaginable as Gilchrist (on 2 at the time) spooned a Nixon McLean (0/38 off 9.4 overs) delivery in his direction at mid on. Somehow, Hinds contrived to juggle and then grass the ball as he attempted to bring it down into his chest from head height. It might have been fractionally more difficult than a chance that he also missed in the Leeds Test against England last year but this was almost as simple as catches ever come.By the time that Gilchrist was finally removed – ironically, courtesy of a lovely diving catch from Laurie Williams at backward point – more than two-and-a-half hours later, the West Indians were crushed both physically and mentally. Amid the torrent of strokes from the two attacking opening batsmen, they looked a completely spent force.”After the initial opening, where they bowled well, they couldn’t put any pressure on us,” said Waugh in a testament to the extent of the West Indians’ difficulties.”It was (merely) a matter of knocking the ball around. But it’s always nice to win and we’ll keep taking that,” he added.Earlier, Hinds (54), Jimmy Adams (44) and Ridley Jacobs (44*) had produced fighting performances to lead their team to its respectable, albeit ultimately inadequate, scoreline. Sherwin Campbell (0) disappeared in the first over, Brian Lara (19) went in the eleventh, and Marlon Samuels (20) was also back in the pavilion before so many as twenty overs had been delivered. But Hinds held the top half of the innings together nicely before finally losing concentration and driving a return catch back to leg spinner Shane Warne (who claimed 3/41 from ten controlled overs). Adams kept things steady in the middle before mistiming a hook at Brett Lee (1/40 off seven) to be well caught by Damien Martyn on the deep backward square leg boundary. And then Jacobs added some polish to the batting in the closing overs to lift the score to a far more competitive mark than might have been imagined when the tourists fell to a mark of 6/174 at the end of forty overs.All the while, though, the run scoring rate never exceeded five per over. On a pitch favouring the batting team, that probably said much in itself about the hold that the Australians managed to maintain. Around comparatively expensive spells from pacemen Glenn McGrath (1/42 from ten), the returning Lee and Nathan Bracken (1/46 off eight), spinners Warne and Andrew Symonds (0/36 from ten) were chiefly responsible for this. Part-time medium pacer Ricky Ponting (1/28 from five overs) was also an early surprise packet and struck a critical blow for the Australians when his very first delivery had Lara outside edging a catch to the wicketkeeper.In a season in which they have already created much history for themselves, the Australians were headed toward establishing yet another new landmark in the process. Having been beaten on all six occasions that they had previously met West Indies in the one-day international arena at the ‘Gabba (a losing record that had stretched all the way back to the 1981-82 season), they emphatically erased that unfortunate legacy.As a consequence of straining a groin muscle in the team warm-up, Australian captain Steve Waugh was actually not among the eleven that completed the win. But it scarcely seemed to matter; Gilchrist was sharp in the field, sharp with the bowling changes, and then sharp with the bat following his fortuitous early escape. He again seemed to revel in the experience of leading his country, applying a midas touch to just about everything his side did.By contrast, the West Indians were brought to their knees in debilitating style. An innings of fits-and-starts with the bat was supplanted by an innings of disasters in the field and with the ball. Murphy’s Law was about the only code applicable to their performance by then.
